License Agreement

1. Subject of the Agreement
This License Agreement (“Agreement”) governs the use of the software product "CodeWeazle" (hereinafter referred to as “the Software”), developed and provided by Matthias Pfersdorff Software Entwicklung (“the Licensor”).

2. Grant of License
(1) The Licensor grants the user (“the Licensee”) a non-exclusive, non-transferable, and revocable right to use the Software free of charge.
(2) Private, non-commercial use is free of charge (freeware).
(3) Commercial use is considered Donationware. While no payment is required for usage, voluntary donations to the Licensor are encouraged to support ongoing development and maintenance.
(4) You are welcome to link, share, or include CodeWeazle in Download archives, but a link to this page (https://www.CodeWeazle.com) must be attached.
(5) The inclusion in paid software archives is strictly prohibited! You are not authorized to republish this Software (or any part thereof) under any other name, with other copyright information or modified in any other way! This explicitly includes packaging in other programs (so-called downloaders) that recommend further software (such as toolbars, system cleanup, etc.) to the user!

3. Copyright and Ownership
(1) The Software, including its code, documentation, and associated materials, is protected by copyright and remains the sole intellectual property of the Licensor.
(2) The Licensee may not copy, modify, decompile, reverse engineer, or redistribute the Software without prior written permission from the Licensor, except where permitted by mandatory law.

4. Disclaimer of Warranties and Limitation of Liability
(1) The Software is provided “as is” and without warranty of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
(2) The Licensor shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use, inability to use, or performance of the Software.
(3) Nothing in this Agreement shall limit liability for death or personal injury resulting from negligence, or for fraud or fraudulent misrepresentation.

5. Updates and Support
(1) The Licensor is under no obligation to provide updates, fixes, or technical support for the Software.
(2) Where updates are provided, they are covered by the same terms and conditions as set out in this Agreement, unless expressly stated otherwise.

6. Termination
The Licensor may terminate this Agreement immediately if the Licensee breaches any of its terms. Upon termination, the Licensee must cease all use of the Software and delete any copies in their possession.

7. Governing Law and Jurisdiction
(1) This Agreement shall be governed by and interpreted in accordance with the laws of England and Wales.
(2) Where applicable under international law, this Agreement shall be construed consistently with the Berne Convention for the Protection of Literary and Artistic Works and other relevant treaties.
(3) Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.

8. Severability
If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
